everything that you just read but we do have an application um from Rose Rock School on Main Street so this uh HUD was approved in 2013 we adopted our Spud ordinance uh which is for less than five acres in 2017 so once they came for an amendment they're changing to a spud just for a little background on that um they're increasing the number of students from 59 to 75 and then adding a couple buildings um including a carport a storage building an outdoor cooking area uh they designated a spot for a Yom which I'll let them explain if you want them to uh and then converting the pool into an underground Greenhouse um so it's pretty much surrounded by R1 right now with a C2 to the West in the East down Main Street so here's an areial of how the school is today not much is changing we have the site plan but here's another aerial view just the front of the school then looking East and looking West on Main Street here's the proposed site plan um so most of the additions will be behind the school on the rear of the property so uh I'm available for questions the applicants here but they don't have a a slide presentation so we're both available for questions uh and then we forward this to come speak y well if you'd like to come give a presentation we'll hear you out hi everybody my name is Brent Swift 1112 Whispering Pines Drive Norman Oklahoma um on behalf of the rose rock board I am a member of the board on Rose Rock School full disclosure my kiddo is a student at this school so um in talking on the board we've made a decision that we would like to increase uh the number of kid kids that we can help uh within the student body and really that that change came about if you reel the clock back back to the pandemic in 2020 what happened in 2020 was that because some children that were already in first grade had kind of gone along maybe six months of school when the pandemic hit there was this Gap in time of about 90 days that we felt like we needed some help so some of us myself on the board and some of the other parents reached out to the school and after asked if they would consider expanding a grades program so that has been embraced and we've made made it work so far but at the end of the day this is kind of the next step in expansion that we would like to do it's not a big step it's basically if you looked at it from a classroom size it's basically nine kiddos and nine kiddos when you kind of put it all together and the structures are you know we're going to remodel the garage would be the biggest step to turn that into classroom space um and then adding a carport just for the people that live there for their cars there is the the flex space of the Yom which is used for music and teaching and handwork and all kinds of crafts and other things that are very important to a wal Waldorf School so I'm happy to answer any questions quick question can you clarify how many students are currently enrolled 54 okay thank you I'm dying to know what a Yom is I'm not familiar so there was a teaser for that I'd love to know yeah a Yom is just basic basically a it's a semi-permanent structure it's basically like a tin shape ttin or tin material it has Windows and has doors but it's a built structure over a basically a floating deck uh that's you know that's used basically primarily for like if a kiddo was you know they're doing like hand workk so maybe six of them would go in the Yom and the teacher would work with them because different teachers work with different points along the education so they could go in and do violin and have violin practice or whatever it's a flex space and I'm also very curious about this underground gardening Greenhouse space just curiosity so yeah so this is beyond my pay grade to understand you know I understand what a greenhouse is but this is a little bit of a mix between a greenhouse and a Subterranean uh where there's water involved and just there's a lot of uh there's just a different hydroponic I think is what they call it maybe I'm not really sure so but it's a greenhouse I mean at the end of the day they're's trying to do a greenhouse and repurpose the pool because it's sitting there empty and it's fenced off and it's just could be it could be repurposed as something really as a teaching tool right that's the whole idea is that once they're more exposed to sciences and botony Etc I think that that they would try to like use that as a teaching tool again I'm not an educator I'm on the board for one thing I know construction pretty well so I know my role thank you any ordinance of the Council of the city of Norman Oklahoma closing a portion of the da street right way to Norman Cleveland County Oklahoma and providing for the severability thereof we'll take our staff presentation good evening Planning Commission my name is Beth mcka assistant City attorney let me figure out which direction I go changes every time um I'm presenting this because I was involved in the Porter Street skate project um and involved in agreements regarding Acquisitions that affect this item the city is an applicant on this item along with Jerry's LLC uh which is the property owner for the property on which Van's Pig Stand is found as well as the Lin trust which is the property owner for the property on which Don's Lock Shop is found so together we have jointly brought this application for the closure of this uh ride of way and so as I said this is occasioned by the porter Corridor streetcape project and um this particular portion of it was a redesign of da um that terminated it in a cue saac you can see the before and after there hopefully it's pretty clear um but essentially the idea of this alteration was to protect the residential nature of DOD Street and keep commercial traffic from going through that large Corridor and as you can see the Acres Porter intersections very close uh so this addressed a lot of um important issues all in one um this is a little bit closer of the current configuration um these uh repairs uh sorry these changes to the streetscape and to Daws were were done TimeWise around the same time that Don and Vans were both doing improvements to their own uh respective properties now uh Don's lock on the North has a primary customer access from Acres Street and um you can see that Vans has two primary accesses for customers off of Porter Avenue still they do have rear accesses off of the new culdesac as you can see that um little strip leads into the back of DA's for um employee parking I believe and then um there is one residence which just barely exits into that culdesac um and then I've uh put a star on 309 which is just to the west of that it's not within the culdesac it's it's a little further down um but I wanted you to see that that is um who we got a protest letter from representing a 1.7% protest of this item um I didn't put the protest map in my presentation I'm sorry I'm kind of new at this particular kind but it is in your packet um as far as the culdesac design goes um the whole street skate project was designed to not further burden you know how tight Porter Avenue and all of that is the idea was to not seek Acquisitions unless we absolutely had to so that the same goes for the Dos cold estack it was fit into existing rideway requiring no Acquisitions from any property owner now that driveway um on the one that exits into the culdesac that was redone um from the sidewalk down it's now concrete it's a gravel going up um but that was redone as part of the project but that area was still already within existing RightWay so no acquisition was required and the idea was um we want uh first to to try to encourage only residential in andout traffic uh this design was kept purposefully smaller to discourage larger Vehicles it accommodates what it needs to and really nothing more for a very specific reason um I I know um you might want to address the protest letter which was discussing the difficulty of buses and other large vehicles but actually um this was designed with rolled curbs so that they could do those difficult turns in there it's functioning as it's supposed to which is again the best solution we found to avoid additional AC positions while allowing what it had to and no more uh so that's the the reasons for the design okay so I wanted to take you through it starting there's no cursor is there sorry starting um kind of in front of Dawn's I wanted to go clockwise around um the actual culdesac here so looking West and north um this house that's in the upper right hand corner is actually owned by Don's lock shop it's on the same property it's used residentially now and as you can see there's a wood fence um on its uh I guess west side and um that provides the barrier now within the cor Porter Corridor area but when that home stops being used for residential purposes the Pud applicable to that property provides that it will become a masonry wall it's only allowed to remain wood right now while that house has not been redeveloped into a different use so that's that's the dawn's and residential side of the culdesac moving clockwise you can see the north and east this shows the dawn's property entirely with the house and then with their commercial property off to the side you can see the accesses off the culdesac there um and actually that one is not an access in That's supposed to be a through Street for the customer parking that's located there um on the North side here's looking east and south where you can see Vans off in the distance and again on the on the east side there you can see Don's uh employee entryway parking their back parking right there and then there's the access to Vans back and then on the far side Vans access and the next residential property next to it and as you can see there is a wall that has been constructed on that boundary uh pursuant to the porter Corridor um overlay here's an aerial um showing the closure area just in relation to the senad and the porter Corridor as you can see this is smack in the middle of the area where those two overlap and you can see again the curve of the culdesac that terminates it and where it ends uh at Porter um so I just wanted to I I I know you know this but um just uh to be absolutely clear this action only closes this for public use there's no tital action that's occurring on the closure item itself uh this ensures that without further action without coming back and talking about it again this portion will not be reopened as a RightWay which means we aren't going to be redesigning it or surprising anyone uh this closure was always planned um in order to ensure that this remained a residential uh Street and so um if this is taken forward pursuant to Oklahoma statute by the private property owners for a vacation action uh that's when Title would change and of course that's when the city um reserves any easements for any utilities it's already placed in the right of way along with any franchise owners as a part of the closure action the franchise owners is have already been contacted and the city has actually already identified its uh needed easements and we did that because again uh as part of our Acquisitions from one owner Vans uh we agreed to bring this in cooperation with the owner so that we could coordinate these items and make it as smooth as possible uh so again those easements have already been identified to the private parties and if a vacation occurs we're ready to specifically reserve them um as I said Vans was already anticipated to be a part of this action but because we had another affected property owner Don's we offered um them the opportunity to voluntarily join the action which they opted to do um so I'm happy to answer any questions you might have I had a question um is uh is this just I mean I guess solely administrative there is there any like visual change to what's going to occur is there going to be like a sign that says close to the public or anything like that um I I don't know if we have traffic yeah no I wouldn't think so and Paul says no uh no I it it's already it's already fully constructed out as planned um I wish I had a cursor to show you or a pointer no I'm sorry uh so just to the Northeast you can see that line of of parking that's now located in that area um that I believe customers of Vans are probably utilizing and then um the drive that was placed uh for the employees to be able to reach that parking on the side of Dawn's uh so so no uh it shouldn't be an issue uh for people to try to go through they they should be able to see that I'm just confirming the intent is after this you are going to vacate the right away further into court as well and so that these would that property right away would go to the adjacent Property Owners the private properties have the option at any time to do that once a property has been closed by the city so no we won't necessarily be a part of the vacation action we would be named as a defendant and we would come in and just make make sure that we're reserving the easements as we've already agreed thank you but it does look like they're already using part of that right away for their parking correct it looks like it from this aerial as though yes yeah I believe part of that agreement with Vans and maybe I should have brought it with me but it actually provided for a revocable license with Indemnity until such time as uh it becomes their title fee property and they can take full warning let me know okay um Brenda Kimmel 309 East doll street I'm further down on the culture sack originally when the virus was very active there was a video conference asking uh questions and they was answered so the one question is can a school bus or a sanitation truck make it through there and I understand they're considering these as big vehicles so they cannot they have to make a certain amount of that CTO saac back up and then continue and I've watched that bus every day do it and on trash day he does it too um we I look at a trailer a white trailer for Don loock shop that carries their wood on the other side of it is a Don loock shop up vehicle I'm interested in having a sound barrier put up there to cover the ugliness that we look at um sometimes the people come up to doll Street of Crawford to go into Vans Peak stand and it looks like a dead end so they continue on um we're interested in the Porter Street being left open 50% of Van's customers use that drive through they go around to the pickup window where they do their ordering and they exit back off on two Porter well I would like that barrier for the vision of it to be more presentable and originally I understand there was going to be trees and plants and a bench the bench is for the customers walking to Don loock shop and is this the part of the uh 2021 uh revising of the Porter Street where they're putting in wider sidewalks and trees and plants um if that Porter entrance is blocked off that means the people will have to go up to acres and then turn on Acres at the light and then turn into Don's lock shop to get over to the Vans through that cter sack if this is to close out up to eventually extend his business it would make more sense to extend his business out into his parking lot and leave that Porter entrance open for the train thank you very much for your comments we appreciate you thank you I also have Denise clear and if you'll again say your name and address to start I'm Denise clear I'm with Don mobile lock shop 3300 Fireside circle is my address um number one I wanted to make it clear that in no way shape or form did lindsy Street trust and Jerry's LLC request the closure of do uh that was all done by the city and part of the project uh we did have to agree to it because if it was that or we had to leave our business um we do however accept the vacancy of the property that's not a problem for us we don't have a trailer and a wood uh the car's wood I don't know what we're talking about there uh the parking lot was requested by the city of Norman to be one way in from acres and exit onto do Street and it has become a thorough mess people go the wrong direction from Vans they use it as a street and so we are we are a street now going from acres to Vans and from Vans back to acres it's going to have someone hurt one like employees almost got run over the other day I'm requesting help from the city planning committee to stop that there are no signs no signs whatsoever except the five or six that I have put up saying do not enter and people don't listen uh when they do exit through Vans they're going the wrong direction the uh up through the entrance to Vans and they're exiting there because they don't know where to go they don't understand that they're supposed to go down to Dos to Peters and then back around to acres so as a business that at this this closure of do has desperately hurt our business um we are we're doing the best we can we don't oppose the the vacancy to the lot we've done everything that we've been requested to do but we feel pretty hopeless right now questions thank you do we have any other audience or public comments seeing none we can move to Planning Commission discussion or see if there's any following questions for staff I I have gone to Dawn's and and my car was almost hit with two cars trying to figure out which way they were supposed to go and it was even confusing for me to leave so um so I do agree that there needs to be signage I think that was a good point asking about signage at the very least um beyond that I mean this was three four months ago so it wasn't in the it wasn't me going over today or just this last couple weeks to look at it once the agenda was posted but I do have Recollections of that being difficult thank you um yeah just uh I I go to Dawn's once or twice a month um and half the time I turn down the wrong Street and get confused about where I'm supposed to go and where I'm not supposed to go it's just not clear and so that was in part while I was asking about signage I just think that um especially with with what's occurred with the business side anything the city can do from a signage standpoint to really help direct traffic um please do other than that it sounds like I mean work's been done it's just a matter of of approving the vacancy at this point I think I am struck with a lot of these comments and maybe um I don't know if Planning Commission is exactly the right voice for um you know talking about traffic would be police there is or uh I'm sorry ticketing you know that would be our Police Department um traffic and signage I know you know working with Shan O from the city staff for that um signage you know we're not doing a zoning request on this we have if we had a PUD or zoning something like that for custom zoning we could make requests for revisions or things like that but like the walls and some of these things those aren't things that we are being asked to look at on this agenda item and just kind of keeping that in mind that we're asked to be look at the RightWay closure in front of us um I obviously I see I can visually see some challenges with that and I would strongly encourage the city to be hearing these comments being made and be working towards a solution for these Property Owners um I just don't know that Planning Commission can solve some of the problems that we heard today from this meeting and as just a point of order we're in Planning Commission discussion right now so um and this item uh would continue on to go to City Council as well so just for the people that are here to speak with the additional scope city council has a larger scope than Planning Commission does there is a first and a second reading and there is an additional opportunity to make protest these are also publicly elected officials that have contact information that you can find they have email addresses and phone numbers that you can reach out to in advance of them reviewing it and also another opportunity for public comment there as well so just making sure you know that after Planning Commission there are other places to be heard on some of these other items too are there any other setting your meeting times uh like City Council uh so it it doesn't need anything that formal but the general Provisions that are applicable to boards and commissions provide certain administrative measures and in the code uh specifically 2-34 there's um guidance regarding internal organization uh which gives each appoint of board or commission the power to adopt such rules and regulations for the orderly transaction of its own business uh this is pretty much uh the authority you would be acting uh uent to in changing your meeting time and what that would look like is choosing that time as confirming the availability of City facilities for the meeting at that time and then um us bringing a resolution back to the next meeting for you to vote on pursuant to 2-34 um as far as uh meeting times as you know they're posted um by the clerk in advance uh so we'll need to allow time for that to happen so that that change can happen and that's because that as you know you're subject to the open meetings act um but otherwise I just wanted to give you all an opportunity to discuss on the record your thoughts and give staff a direction into how we should bring this back to you thank you I know that that discussion item was actually posed by commissioner jabloni Who present here tonight um but for his benefit if there any other commission discussion or questions maybe on changing that time or propos times that you'd like to discuss you have a time in mind better it was in our minutes I think it was 400 p.m but I would defer to the minutes to confirm I don't think it may not be in the I don't think it is uh I know one of the things that Miss mcka had brought up was the availability of facilities and I I would venture and especially as the state is heavily looking at open meetings Act right now and making sure that public meetings are available to the public um not putting two public meetings at the same time because a public member couldn't be in two places at the same time uh there is currently a meeting that happens it's the oversight committee meeting I believe every thir it's the same day as Planning Commission but it happens at 4 p.m.

It isn't in here I think it is in the conference room but it is at the same time so um I would in general say if there is a proposed time Laura just mentioned to me that there is a different one every Thursday at 4 pm so Thursdays at 4M are pretty regularly going to have a time slot on there um I have spoken with a council member before that has indicated sometimes they struggle to get out in time to give enough time also for our tech people to have a chance to set everything up so just being considerate to staff there too that they probably need maybe at least 30 minutes but maybe they could add comment to that if there's amount of time that they would kind of need to wrap up that meeting before starting this one so question just to clarify you say when they they struggle to get out meaning to get out to the get then get to this meeting uh I would I would say that to finish in time to properly end that meeting move the it equipment setup over and then start our meeting because if that oversight committee goes longer than two hours you have less than 30 minutes for the it setup of this meeting so um just kind of being mindful of that that not even by moving up to 5:30 we now would be potentially encroaching on time that currently city council has available for their committees so um yeah and also just being mindful of we many times have short meetings but some sometimes our meetings are long too if we stack something in earlier than that uh and maybe you as a point of order could clarify we have meet we don't have any meetings after us currently but I believe by our Rules of Order if we did not meet agenda items before a certain fixed ending time those would roll over to the next meeting and maybe you could clarify that the open meetings act requires that the beginning time be posted but actually not an ending time the only thing that would constrict the end of a meeting is another meeting in that um same space at the at a spec specified time so you'd still want to do a motion to postpone them to the next meeting it's not something that would happen as a operation of law um I I do want to clarify and I I I don't want to speak out of turns and surprises here I I think we have had a situation where we're able to finish up a meeting in here while preparing for another meeting in here so I think there is the ability am I am I misstating that I'm sorry we don't often drag you into these things I apologize um we're talking about the ability to set up uh for a meeting in here while a meeting in the executive conference room is finishing up is that something that's possible yes yeah um the I mean really the the main thing is whether we can live stream or not we can only live stream one meeting at a time so if we have a meeting going on in the executive conference room um that is being live streamed we would have to wait until that meeting was done to start another stream in here because both both of these rooms use the exact same system so that's really the only hindrance so is that meeting being live live streamed uh our our committee meetings Thursday committee meetings get live streamed um they start at 4 o'clock um there's no telling how long they run sometimes they're an hour the one today was 12 minutes so yeah just to clarify can you immediately stop a stream and then start the other one or is there a gap of time that you need to uh I mean just need a little bit of of change over I mean like 10 15 minutes if I'm if I'm really rushing kind of depends on on what it is but I mean we can usually get things changed over fairly fast I'd like to make the comment that I think one of the reasons we'd be I think some of our commissioners are interested in moving the time up is to also be considerate of our staff half time so I would be in favor of not asking you to rush and being considered of your time that it takes to do your job I I would very much appreciate that so so can we get an idea of how long that meeting takes is it is it an hour I know that meetings don't take as long or I mean what's the average um I I mean the committee meetings are not standardized I I would say lately they've been going right at about an hour um so ending right around 5:00 but I've had some of those committee meetings that have gone three hours long um it's been a while since we've had one like that so in that case would they um if we had a standing meeting would they have to go ahead and adjourn so we could start uh well uh they wouldn't necessarily have to adjourn they would just have to agree that we could cut off the live stream for them and start the live stream for for this one we have done that before we've had some meetings that were going a little long and and uh they had been told you know we we need to we we we have a certain cutof off time um and we we had to start the meeting in here so we would have to kind sort of cut off that live stream to start this we can do that um just really depends on you know how everyone feels about that and Beth could you just answer is the live stream at all part of our compliance with open meetings act or is this as a service for accessibility that we offer it is not part of our compliance with the open meetings act it is our policy to provide it people expect it of course and we and we try to do that um and but I would second what Bryce said is is is when we know we have another meeting usually the committee is aware and conscious of that and tries to wrap up their business within the time frame they just consider it kind of mentally their hard stop time so you said it rotates what committee meets um at 4:00 what committee meets at 4:00 on the what are we the second Thursday oversight committee okay thank you sorry you said that earlier and also because they're all on the YouTube the recordings are also available you could scroll through the there's a section on the YouTube that you can click for open meetings act like the public live streams public meetings and you can just see the length you don't even have to open them you could see the length of each of the YouTube videos to get a sense of that too I don't know if there is there any other thoughts comments discussion to make I think we should consider maybe 5:30 and then uh if to cut off there would get us here a little earlier and and uh an ad depending on the length of our meeting but I don't think that would be unreasonable most committee meetings well when I was on Council most committee meetings didn't start till 5:30 so um that would get us in and out of here a little sooner depending on the the the agenda but it's a thought I'm I'm okay with 5:30 to because I you know staff they're this is not their only meeting that they have to come to and and my thoughts are just as soon as we can start we can hopefully get through the meeting and get staff home I mean that's that's just my thoughts yeah I um I was on historic district commission for nearly six years we started we actually moved our time up from 600 to 5:30 and I just remember that little change it just made everything more efficient because everybody was kind of still in business mode if you will and kind of continue with the day and and staff could just transition right over so I I I like that time that's what there's some consensus around it can we ask uh for what do you think you're the one that makes it go so I'm just making sure that no comment I do what I'm told okay most of the time uh I the only other I have recently been engaging a little bit more with the live streams for the City Council meetings and and there is miscellaneous comment from the public in there too and um recently I've heard a lot of the public comment on changing unexpectedly meeting times so I think it's just important for us in our job to have consistency and just not having a random schedule that we change every week but I don't see any problem with it becoming the new Norm being 530 um I do also Planning Commission is a more important more meaningful committee for a lot of property owners that are going to be or neighbors that are adj to these properties and I do still think that a time after 5:30 allows more people to be able to attend um currently when we had covid we were able to do Zoom participations we had YouTube questions we had more accessibility that people did not have to physically be here to make their comment um as a reminder the public can always submit letters and protests and we get them many pages long and we read them all so there are also ways that uh the community can participate with Planning Commission in advance as well but I mean still making sure people that have a job can not have to take off early to be able to come and speak at this meeting I think is still of value at this point so I think a 5:30 time is a great middle ground for that I think that's a great suggestion uh so as a point of order from here would we just request a consideration for that resolution to be on our agenda for next meeting yes uh I would draft it um we would bring it back for your consideration and vote if there's anything in it that wasn't thought of beforehand or that looks wrong it could be an amendment on the floor just as long as we notice it appropriately in the agenda um I I do want to clarify we're we're talking about moving it up to 5:30 and I presume that is for the same day of the month no discussion of moving the day yes yes okay okay all right any any other discussion on this item or from the public all right uh seeing none we'll move to just our miscellaneous any other uh staff information for the commission Sor I was muted I was trying to get your attention um um in light of being considerate of your time does this cut out your ability to eat or anything like that between your workday so this means it does this make it harder on you rather than easier on you it was just me personally it makes it harder okay I have a dog at home oh okay I get that because the rest of them don't go home so it's just me and I won't be here forever gosh does that change anyone's maybe six feelings or opinion uh maybe maybe we could request that the planning director kind of do a little bit of review for their staff and uh maybe make a comment to that effect and some of the feedback that she might collect from her staff members um I think that would be something I would request for that agenda item next time really not necessary so yeah we'll let her we'll let the staff tell us what they think too because that's one one of the things we'd like to consider so I think it's fair to ask for that so maybe based on feedback it could be six versus 5:30 I'd like to go ahead and put it on as the earliest time for the agenda that we're considering okay because I feel for the public comment sake you know I think the earliest that that change would impact is the most important 5:30 is better than 6 because six isn't enough time to go home and come back okay and E okay yeah can make a floor Amendment too so thank you for clarifying that okay all right any other is there any more discussion on this item seeing none uh does
